The first question is the cost of a legal defense. A major concern when facing criminal charges is “how much will my defense cost me?” The answer depends on the factual circumstances of your case, the experience and qualification of the attorney representing you. FIXED PRICE VS. PAY AS YOU GO

Be very concerned about contracts that charge on a “pay as you go” basis. The uncertainty of situations,as well as unforeseen developments, could create a situation where you find yourself out of funds in the middle of the criminal process. An attorney, that is not confident enough in his or her abilities to assume the risk of giving you a fixed price, is one that you may wish to think twice about and in whose hands you are placing your fate. Also, ask for a written agreement. This avoids any misunderstandings and potential hardship on you, the client.

Are there any additional expenditures? Beware of the possibility of any additional expenditures such as investigators, doctors and other possible non-lawyer personnel. Are you paying extra for costs? Are you paying for depositions? Some attorneys have been known to charge for photocopies and even stamps.

IS TRIAL INCLUDED IN THE PRICE?

Some attorneys appear to be inexpensive by excluding costs for discovery, depositions and trial preparation, allowing them to be billed later, as an afterthought. The difficulty with this approach is that the work needed to obtain a strong favorable trial outcome occurs before the trial begins. It is well established, that good trial preparation often results in a settlement or even a dismissal of charges before the case develops into a trial posture. Avoiding trial preparation, in order to save money, might actually cost dearly in the long run. You will have to now absorb the costs, not addressed on the front end, on the back end, for trial ; which will result in a higher fees and most likely a worse case result: too little, too late, and too expensive!
